The following document describes the terms of service of PrestoShopper/InstaShops/Presto CSAT/Liveshops ("Presto") for any and all Clients who may use Presto in the course of their data collection activities.
Your use of any of Presto's services implies that you have read, understood and agreed to these terms. Your acceptance is indicated by selecting the check box below. If you fail to indicate your agreement, you will no longer have access to the Presto platform.
The web pages and services available at prestomobilesurveys.com, prestometrics.com, prestoinstashops.com, and all their linked pages ("Site") are owned and operated by LiveShopper Sassie ("Presto", "We", "Us") and are accessed by you, subject to the Terms of Service described below ("Terms").
Please read this Terms of Service Agreement ("Agreement") carefully before using this Site. By checking the acceptance box below, and using the Site, you agree to be bound by these terms and conditions. Any violation of these terms and conditions may result in your immediate loss of access to the Site.
This Agreement constitutes the entire and only agreement between you and Presto, and supersedes all prior or contemporaneous agreements, representations, and understandings with respect to the Site.
Presto reserves the right to change the terms of this agreement at any time. The latest Agreement will be posted on the Site. If any changes constitute a material change in the Terms (as determined by Presto, or as mandated by law), we will notify you by presentation of a new Agreement upon your next login, and require your acceptance of the Terms as modified before further use of the Site. Should you choose to reject the modified Terms, you may contact Presto for final access to export such data as is allowed within the bounds of national and international privacy laws.
The Site is a web-based service for creating and editing surveys and collecting and viewing survey results. Services include, but are not limited to, tools to create and edit surveys and make them available to survey takers, survey data collection, and reports of survey results.
Presto reserves the right to suspend or discontinue the availability of the Site and/or any service at any time at its sole discretion, without liability. In the event of suspension for nonpayment, or for activity that is illegal or hostile to the platform (including but not limited to hacking or hacking attempts, theft of content, attempts at reverse engineering, misrepresentation, or violation of national or international privacy laws), service may be suspended or permanently discontinued without notice. Otherwise, 60 days' notice will be provided, with guaranteed availability during that time to export such data as is allowed within the bounds of national and international privacy laws.
Presto may also impose limits on certain features and Services or restrict your access to parts of or all of the Site and the Services without notice or liability.
Your access to or use of this Site may be interrupted from time to time as a result of updating, maintenance or repair of the Site or its supporting hardware; equipment malfunction, or for any other reason within or outside the control of Presto. Presto does not warrant the Site to be error-free, or to have security beyond that which is mandated as reasonable by law. We do not warrant that defects which do not infringe upon your rights or freedoms will be corrected, or that the Site (or the server(s) on which it is hosted) or software are free of viruses or other harmful components.
Presto does not warrant the suitability of the Site for any particular purpose. You assume total responsibility for your use of the Site and the software and your reliance thereon.
As a condition of using the Site and its Services, you are required to create an account with Presto and provide an email address and a password. The email address you provide is our primary means of contacting you, and must be valid and reachable. Your registration information must be accurate, complete and current at all times.
You are responsible for maintaining the confidentiality of your password and for any and all use of your account. Agreement to these Terms indicates agreement on behalf of the account itself.
All results of your Evaluations ("Survey Data") are available to you for a period of 2 years from the time that the Evaluation is completed, provided that you maintain a current Subscription. If your Subscription lapses, your Survey Data will no longer be available. If you reactivate a lapsed account, Presto makes no guarantee that your former Survey Data will be available.
Any incentive that you offer as a Presto survey incentive coupon ("Incentive Coupon") must be valid and redeemable for a reasonable period after any of the survey's Evaluations are completed.
Personally Identifiable Information
Personally Identifiable Information ("PII") is defined as information that can be used on its own or with other information to identify, contact or locate a single person, or to identify an individual in context. Examples include, but are not limited to:
Sensitive Personally Identifiable Information ("SPII") is defined as information that if lost, compromised, or disclosed could result in substantial harm, embarrassment, inconvenience, or unfairness to an individual. This includes (but is not limited to):
In addition to information collected and/or submitted by individuals completing surveys, Presto collects the following information from Insta-Shoppers:
This information can be seen by reviewers (members of your staff who review InstaShops or LiveShops), with year of birth represented as approximate age (e.g., "shopperemail@gmail.com (Male, 30-31 years old)"). You may share gender and approximate age data with your clients (through the Presto shop view), but may not share Shopper email addresses.
Metadata regarding the evaluation is used to assist in fraud detection, but will not be made available to you.
You may use Presto to collect PII under the following conditions:
For Presto CSAT (all the following conditions must be met)
Presto InstaShops or LiveShops (one set of conditions must be met)

Please note: Shopper email addresses are not to be shared with clients or with anyone other than authorized members of your staff and Presto support staff, and are not to be used for the purposes of contact unrelated to Insta-Shops that have been claimed by this Insta-Shopper.
You may use Presto to collect SPII under the following conditions:
If legal IDs must be collected as part of your Presto project, you are strongly encouraged to use Presto’s User Images feature rather than survey questions. This keeps the SPII contained in the legal ID separate from shop data and minimizes the possibility of inappropriate exposure.
If an individual requests that you delete their SPII, you must comply immediately and confirm with them that their information has been deleted.
By entering into this agreement, you accept full legal responsibility for the actions of yourself and your employees with regard to any and all private or sensitive information collected from evaluators. Presto assumes no liability with regard to the misuse of data collected via our platform.
You agree that all information that you provide to Presto and/or to merchants or service providers acting on Presto's behalf will be accurate, complete and current. You further warrant you are authorized to use any payment method that you submit to us.
Presto reserves the right to change its pricing without prior notice.
